		<description>&quot;Reasonable Diligent Search&quot; reminds me of Montana&#039;s &quot;Reasonable and Prudent&quot; speed limit in the late &#039;90s.  Anyone could interpret the meaning anyway they wanted and drive 45 or 85 MPH on a highway where truckers could only drive 65 MPH.  What a nightmare!</description>

Ask people to describe the Mona Lisa in words, and you&#039;d get  a lot of vague, general results (&quot;smiling woman in black with hands in front&quot;) that could match LOTS of different drawings. What if the drawing is a caricature and I don&#039;t recognize the subject? If there&#039;s a caption it gets a little easier, but only if the caption has been entered as text (rather than as part of the image).

		<description>Without seeing the actual legislation it&#039;s hard to know if there is anything to be upset about. To my mind it comes down to what kind of minimal search is required and what kind of compensation (and how easy it is to collect that compensation) a copyright holder can receive if they discover an unauthorized use.</description>
